AG MARSHALL ANNOUNCES COURT OF CRIMINAL APPEALS UPHOLDS JEFFERSON COUNTY CAPITAL MURDER CONVICTION

            (MONTGOMERY)—Attorney General Steve Marshall announced that the Alabama Court of Criminal Appeals on Friday upheld Evans Lewis Butler’s conviction for capital murder. Butler, 42, was convicted in August of 2016 for the murder of Alfonzo Minter. The murder was made capital because it was committed while Butler was serving a sentence of life imprisonment.

            The evidence at trial showed that Butler, who was serving a life sentence, stabbed Minter at Donaldson Correctional Facility. The autopsy revealed that Minter received seven wounds to his body, two of them fatal:  stab wounds to the heart and to the right lung.  As Corrections officers were beginning to lock down the portion of the prison where Minter was found, Butler admitted the murder to two of the Corrections officers.

            The Butler case was prosecuted at trial by the Bessemer Division of the Jefferson County District Attorney’s Office. Butler was sentenced to life imprisonment without the possibility of parole.  He subsequently sought to have his conviction reversed on appeal.

            The Attorney General's Criminal Appeals Section handled the case during the appeal process, arguing for the Alabama Court of Criminal Appeals to affirm the conviction. The Court did so in a decision issued on Friday, September 1.  Attorney General Marshall commended Assistant Attorney General Beth Slate Poe of the Attorney General’s Criminal Appeals Section for her successful work in this case.
